By downloading, installing, or using the Fishkeeping Handbook app (the “App”), you agree to be bound by these Terms of Use (the “Terms”). If you do not agree to these Terms, do not use the App.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal and non-commercial purposes. You agree not to reverse engineer, modify, or resell the App or any part thereof.

3. App Content and AI Disclaimer

All fish-related information within the App is generated by artificial intelligence and is provided for informational purposes only. We do not warrant the accuracy, completeness, or usefulness of any information. You acknowledge and agree that any reliance on such material is at your own risk.

4. Donations

• Users can make optional contributions through Apple's in-app purchase system.
• Donations do not unlock any features or confer any special status within the App.
• All payment processing is handled by Apple, and we do not assume any liability related to payment issues or refunds.

5. User Conduct

You agree not to:

• Use the App for any unlawful or fraudulent activities.
• Interfere with the security or operation of the App or servers or networks connected to the App.
• Collect or store personal data about other users.
• Upload or transmit viruses or other harmful code.

6. Intellectual Property

All text, images, graphics, logos, and other content in the App (“Content”) are owned by or licensed to us. You may not copy, reproduce, distribute, or create derivative works from the Content without our express written permission.

7. Disclaimer of Warranties

THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF THE DATA.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE APP.

9. Indemnification

You agree to defend, indemnify, and hold harmless Gourami Studios, its affiliates, and their respective officers, directors, employees, and agents from and against all claims, damages, losses, and expenses arising out of or related to your use of the App or violation of these Terms.

10. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the courts located in the UK, and you consent to such jurisdiction.

12. Changes to These Terms

We may modify these Terms at any time. If we do, we will update the “Last Updated” date at the top of this document. Your continued use of the App after any changes indicates your acceptance of such changes.
